These Terms of Use ("Terms") govern your use of the Rondo Radio application and related Rondo services (collectively, "Rondo").
Rondo is provided by Fambridge Trading Inc., an Ontario, Canada corporation ("Fambridge", "Rondo", "we", "us", or "our").
By downloading, accessing, or using Rondo, you agree to these Terms. If you do not agree to these Terms, do not use Rondo.
1. The Rondo Service
Rondo is a curated internet radio application that helps users find and listen to selected radio stations and live audio streams.
Rondo provides features including station browsing and search, radio playback, Favorites, Recent Stations, optional account functionality, and supported in-vehicle playback interfaces such as Apple CarPlay. Where available, enhanced features may include Favorites Sync, Timer, Sleep Timer with Rondo Sleep Fade, and track information supplied by supported stations or sources.
Basic radio browsing and listening remain free and do not require a Rondo Account or paid subscription. Enhanced features may require signing in and an eligible Rondo Membership entitlement, as explained below.
2. Third-Party Radio Stations and Content
Most radio programming available through Rondo is produced, owned, transmitted, or distributed by independent broadcasters, radio stations, networks, content owners, streaming providers, or content delivery networks.
Unless expressly stated otherwise:
- Rondo is not the broadcaster of third-party radio programming;
- Rondo does not own the music, programs, news, commentary, advertisements, or other content transmitted by third-party stations;
- station names, trademarks, service marks, logos, artwork, programming, and other third-party materials remain the property of their respective owners; and
- inclusion of a station in Rondo does not by itself imply sponsorship, endorsement, partnership, or affiliation between Rondo and that station or content owner.
Rondo provides a curated interface for locating and accessing internet radio streams and related station information.
2.1 Sources and Presentation
Rondo may identify and provide access to stations using information obtained from sources such as official broadcaster websites, broadcaster-published stream endpoints, official or authorized metadata feeds or APIs, and information supplied by stations or rights holders.
Rondo may display station names, logos, artwork, descriptions, schedules, stream information, and related metadata to identify, describe, and provide access to the relevant station or programming.
Public availability of a stream, website, API, logo, artwork, or metadata does not transfer ownership of that material to Fambridge. Rondo's access to third-party services remains subject to applicable law and the terms, permissions, and technical conditions governing those services.
Fambridge may suspend, modify, replace, or remove a stream, station listing, artwork, metadata source, or related integration when reasonably necessary because of a rights-holder request, a change in source terms or permissions, a licensing concern, an access restriction, or another legal or operational issue.
2.2 Materials Supplied by Stations and Rights Holders
If you are a broadcaster, station operator, network, content owner, or authorized representative and you submit or otherwise provide Fambridge with a stream URL, station name, logo, trademark, service mark, artwork, description, schedule, metadata, or other material for inclusion in Rondo, you represent and warrant that you are authorized to provide that material and to grant the permission described below.
By providing such material for inclusion in Rondo, you grant Fambridge a non-exclusive, worldwide, royalty-free license to use, reproduce, technically adapt where reasonably necessary for presentation or delivery, display, distribute, and make available the submitted material solely as reasonably necessary to list, identify, present, operate, and promote the availability of the relevant station through Rondo and related Rondo services. Technical adaptations may include resizing, cropping, formatting, or other non-substantive changes required for application interfaces and supported devices. This permission includes use by service providers and distribution platforms acting for those limited purposes.
You retain ownership of your material. You may request correction or removal by contacting [email protected]. Fambridge may retain limited records documenting the submission, permission, request, and resulting action where reasonably necessary for legal, security, or operational purposes.
2.3 Rights-Holder Corrections and Removal Requests
If you represent a station or rights holder and believe that a station listing, stream, logo, artwork, metadata, or other material presented through Rondo is inaccurate, unauthorized, or infringes your rights, please contact [email protected].
To help Fambridge evaluate the request, please identify the station or material at issue, where it appears in Rondo, the correction or removal requested, the basis for the request, and information reasonably sufficient to confirm that you are the rights holder or are authorized to act for the rights holder.
Fambridge may request additional information where reasonably necessary, and may temporarily disable or remove the relevant material while a request is being evaluated. Fambridge reserves the right to correct or remove third-party material when appropriate.
3. Station and Stream Availability
Internet radio availability is controlled in substantial part by third parties and may change without notice.
A station, stream, program, bitrate, format, schedule, or other service may become unavailable, interrupted, delayed, geographically restricted, replaced, or modified because of broadcaster decisions, licensing restrictions, network conditions, content delivery changes, scheduled broadcast hours, technical failures, or other circumstances outside Rondo's control.
Rondo does not guarantee that any particular station, stream, program, or geographic availability will remain continuously available.
Some stations operate only during specified broadcast hours. Rondo may prevent playback outside an identified broadcast window when that schedule is known to Rondo.
4. Live Radio
Rondo is designed primarily for live radio listening. It is not a DVR, recording service, or time-shifting service.
Rondo does not provide a feature intended to record, download, save, convert, or redistribute third-party live radio programming for offline use. Temporary technical buffering that is inherent in ordinary streaming playback does not create a user-accessible recording.
Pausing or interrupting playback does not create a guarantee that Rondo will preserve an earlier position in a live broadcast. When playback resumes or reconnects, Rondo may return to the station's current live programming.
5. Rondo Accounts
A Rondo Account is optional for ordinary radio listening.
Certain Rondo features require a signed-in Rondo Account, and some enhanced features additionally require an eligible Membership entitlement. Creating an account or signing in does not, by itself, grant paid Membership benefits. Rondo uses supported third-party identity providers, including Apple and Google, to authenticate account users. Rondo does not provide a first-party Rondo password.
Rondo maintains its own internal account identity. A supported Apple or Google identity may be linked to that account as an authentication method.
You are responsible for maintaining appropriate control over the Apple, Google, or other provider account you use to authenticate to Rondo.
6. Linking Authentication Methods
Where available, a signed-in user may explicitly link supported authentication methods to the same Rondo Account.
Rondo does not automatically merge accounts solely because two authentication providers supply the same or similar email address.
An authentication identity that is already associated with another Rondo Account cannot be silently transferred or merged into the current account.
7. Favorites and Local App Data
Without a Rondo Account, Favorites are stored locally on the device.
When you sign in and have an eligible Membership entitlement, Favorites may be synchronized with your Rondo Account across supported devices. Without synchronization access, Favorites may remain device-local.
Recent Stations and certain feature state, including active Timer and Sleep Timer state, are stored locally and are not necessarily synchronized with your account.
Removing the App, erasing or resetting a device, or clearing application data may result in loss of locally stored information.
8. Account Deletion
Rondo provides an in-app method for an eligible signed-in user to initiate permanent deletion of a Rondo Account.
Deleting an account is different from signing out.
After successful account deletion, Rondo deletes or disassociates account information that is no longer required for legitimate legal, security, fraud-prevention, or operational purposes, as described in the Rondo Radio Privacy Policy.
Deleting your Rondo Account does not prevent you from continuing to use Rondo's non-account radio-listening functionality.
Deleting your Rondo Account or removing the App does not cancel an existing Apple App Store or other platform-store subscription. To stop future renewal charges, cancel the subscription through the store where you purchased it, preferably before deleting your Rondo Account. Membership access associated with a deleted Rondo Account may no longer be available, even if a store subscription remains active.
9. Rondo Membership and Subscriptions
9.1 Optional Membership and Included Features
Rondo Membership is an optional enhancement to Rondo's free radio-listening service. Depending on the App version, platform, station support, and the Membership entitlement available to you, eligible features may include Favorites Sync, Timer, Sleep Timer with Rondo Sleep Fade, and track information where available. Song and artist information depends on third-party station or metadata availability and is not guaranteed for every station.
Membership benefits require a supported, signed-in Rondo Account and an eligible active entitlement. Entitlements may arise from a platform-store subscription or a complimentary or promotional grant. A Rondo Account and a store billing subscription are distinct from the Membership entitlement Rondo verifies for feature access.
9.2 Purchase, Billing, and Automatic Renewal
Where subscription plans are offered, purchases are processed by the applicable platform store, such as the Apple App Store, rather than by Rondo directly. The available plan, localized price, currency, billing period, taxes if applicable, and payment terms are shown by the store before you confirm your purchase. Rondo does not collect your payment-card details for App Store purchases.
The Rondo Membership Annual plan is an auto-renewable annual subscription. Unless you cancel automatic renewal through the store, it renews at the price and on the terms disclosed by the store, subject to any changes communicated in accordance with applicable store rules and law. Your subscription may continue to renew even if you stop using Rondo or delete your Rondo Account.
9.3 Introductory Offers and Free Trials
Where displayed by the App Store, eligible customers may receive a three-month introductory free trial of the annual subscription. Eligibility is determined by the applicable store and may depend on prior subscriptions or introductory offers in the same subscription group. The offer duration, applicable conditions, and price to be charged after the free period are presented by the store before purchase. Offers may differ by region and availability.
Unless you cancel automatic renewal in time under the store's applicable rules, a free trial converts into a paid, automatically renewing subscription when the introductory period ends. Canceling may affect access to the remainder of an offer according to the store's rules. Review the purchase and subscription-management screens for the terms that apply to your subscription.
9.4 Managing or Canceling Subscriptions
You may manage or cancel an App Store subscription through your Apple Account's subscription settings or through Rondo's available subscription-management link. For subscriptions purchased on another platform, use that platform's subscription-management process. Uninstalling Rondo, signing out, or deleting a Rondo Account does not cancel a store subscription.
Turning off automatic renewal generally prevents the next renewal charge but does not by itself immediately terminate a Membership entitlement that remains valid through the current paid period, subject to the applicable store's terms. Rondo verifies eligible subscription status to determine feature access; expiration, refunds, revocation, or other billing changes may result in loss of paid Membership benefits.
9.5 Refunds and Consumer Rights
Requests for refunds of store-billed subscriptions are handled through the applicable store's refund process, subject to its policies and applicable law. Nothing in these Terms limits non-waivable consumer or statutory rights. For questions about Rondo's Membership features or account access, contact [email protected].
10. Personal and Lawful Use
Rondo is provided for lawful personal use.
You may not:
- use Rondo in violation of applicable law or third-party rights;
- interfere with or disrupt Rondo, its servers, APIs, security systems, or networks;
- bypass or attempt to bypass authentication, authorization, app-integrity checks, rate limits, source protection, or other technical safeguards;
- use automated systems to scrape, harvest, enumerate, copy, or bulk-download protected Rondo service data or playback-source information;
- obtain or attempt to obtain unauthorized access to another person's account or data;
- transmit malicious code or use Rondo to attack or compromise another system; or
- misrepresent your identity in order to gain unauthorized access to Rondo services.
Nothing in these Terms restricts rights that applicable law gives you and that cannot legally be waived.
11. Network and Carrier Charges
Rondo requires an internet connection for internet radio playback and cloud-based functionality.
Your internet service provider or mobile carrier may charge for data used by Rondo. You are responsible for charges imposed by your provider.
12. Safe Use and CarPlay
When using Rondo in a vehicle, you are responsible for following applicable traffic and distracted-driving laws.
Do not interact with Rondo in a way that distracts you from driving. Use CarPlay, vehicle controls, voice controls, or other interfaces only when it is safe and lawful to do so.
13. Rondo Intellectual Property
Rondo's software, user interface, original design, Rondo branding, original graphics, documentation, and other materials created by or for Fambridge are owned by or licensed to Fambridge and are protected by applicable intellectual-property laws.
Subject to these Terms and applicable distribution-platform terms, you receive a limited, personal, non-exclusive, non-transferable license to use Rondo for its intended purpose.
No ownership interest in Rondo or Fambridge intellectual property is transferred to you.
Third-party station names, logos, trademarks, programs, recordings, artwork, and other third-party content remain subject to the rights of their respective owners.
14. Feedback and Station Reports
Rondo provides tools that allow you to prepare feedback or a station report and send it using an email or sharing service you choose.
Submitting feedback is voluntary.
If you send feedback, you authorize Fambridge to use the information you provide to review the report, communicate with you where appropriate, troubleshoot Rondo, correct station information, and improve the reliability and usability of the service.
Do not include passwords, authentication credentials, confidential information, or other sensitive information that is not necessary for the report.
15. Third-Party Services
Rondo relies on third-party services for portions of its functionality. These may include operating-system services, authentication providers, cloud infrastructure providers, broadcasters, streaming providers, content delivery networks, and email services.
When you choose a station, your device may connect directly to a broadcaster or its streaming or content-delivery provider. The availability, content, and independent practices of those third parties are outside Rondo's control.
Your use of third-party services may also be governed by their own terms and policies.
16. Changes to the Service
Rondo may modify, correct, suspend, or discontinue parts of the service when reasonably necessary for operational, security, legal, licensing, compatibility, or technical reasons.
Rondo may also add, remove, or update stations as part of its editorial and operational management of the curated catalogue.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Rondo is provided on an "as is" and "as available" basis.
Fambridge does not guarantee that Rondo or any particular third-party station will always be available, uninterrupted, error-free, geographically available, or free from temporary technical problems.
Station metadata is maintained with reasonable care, but broadcaster information, schedules, artwork, stream addresses, and availability may change independently of Rondo.
Nothing in these Terms excludes or limits warranties, guarantees, or consumer rights that cannot lawfully be excluded or limited.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Fambridge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of Rondo, interruption of a third-party stream, loss of locally stored app data, or the acts or omissions of an independent broadcaster or third-party service.
Nothing in these Terms excludes or limits liability where applicable law does not permit such exclusion or limitation.
19. Suspension of Access
Fambridge may restrict access to Rondo services or a Rondo Account where reasonably necessary to address security threats, abuse, unlawful activity, attempted unauthorized access, or material violations of these Terms.
You may stop using Rondo at any time.
20. Privacy
The Rondo Radio Privacy Policy explains the information Rondo processes, the purposes for that processing, how information is protected, and the choices and rights available to users.
21. App Store and Distribution Platform Terms
If you obtain Rondo through the Apple App Store, your acquisition and use of that copy of the application are also subject to the applicable Apple Media Services terms and Apple's standard Licensed Application End User License Agreement, unless a different applicable license is presented through the App Store.
If you obtain Rondo through Google Play, your acquisition and use of that copy of the application are also subject to the applicable Google Play Terms of Service and other Google Play terms and policies that apply to you.
Fambridge, rather than Apple or Google, operates the Rondo service and is responsible for Rondo and its operation, except to the extent that applicable platform terms or law provide otherwise. Apple and Google do not control the third-party radio programming made available through Rondo.
Other application-distribution platforms may impose additional terms that apply to your acquisition or use of the copy of Rondo distributed through that platform.
22. Changes to These Terms
Fambridge may update these Terms when reasonably necessary to reflect changes in the service, applicable law, security requirements, or legal obligations.
If a change materially affects users' rights or obligations, Rondo will provide notice in a manner appropriate to the change.
The effective and last-updated dates shown at the top identify this published version.
23. Governing Law
Except where mandatory law provides otherwise, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
Nothing in these Terms limits mandatory consumer rights that apply to you based on the jurisdiction in which you live.
